By accessing or using CallVelocity's platform, website, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

CallVelocity provides an AI-powered call intelligence platform that analyzes inbound telephone call recordings to generate sales performance scores, coaching recommendations, and business intelligence for sales teams and service businesses. Features include call transcription, scoring, missed opportunity detection, rep scorecards, CRM integration, and reporting dashboards.
You must create an account to use the Service. You agree to:

Important: Call recording consent laws vary by jurisdiction. In many US states and countries, recording a phone call requires the consent of all parties. You are solely responsible for ensuring your use of CallVelocity complies with all applicable laws regarding call recording, notification, and consent.
CallVelocity does not provide legal advice. By using the Service, you represent and warrant that you have obtained all legally required consents for any calls you process through our platform. You agree to indemnify and hold CallVelocity harmless from any claims arising from your failure to obtain required consents.
Subscriptions: The Service is provided on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate.
Billing cycles: Monthly subscriptions are billed on the same day each month. Annual subscriptions are billed upfront for the full year.
Call overages: If you exceed your plan's monthly call limit, we will notify you and may charge overage fees or upgrade your plan as agreed.
Refunds: Subscription fees are non-refundable except as required by applicable law or as expressly stated in your order form. If you believe you have been charged in error, contact us within 30 days.
Price changes: We may change subscription prices with 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.
Our IP: CallVelocity and all associated software, AI models, algorithms, trademarks, and platform content are owned by CallVelocity, Inc. These Terms do not grant you any ownership rights in the Service.
Your license: Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
Feedback: If you provide feedback or suggestions about the Service, you grant us a perpetual, royalty-free license to use that feedback without restriction or compensation to you.
You retain all ownership rights to your call recordings, transcriptions, and business data ("Customer Data"). You grant CallVelocity a limited license to process Customer Data solely to provide the Service.
We do not use Customer Data to train our AI models without your explicit consent. See our Privacy Policy for full details on how we handle your data.
Each party agrees to keep the other's confidential information (including your call data and our product roadmap and pricing) confidential and not to disclose it to third parties without consent, using at minimum the same care as it uses for its own confidential information.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED ANALYSIS WILL BE ACCURATE OR COMPLETE.
AI call analysis is provided as a decision-support tool. You remain solely responsible for all business decisions made based on CallVelocity's outputs.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLVELOCITY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL CALLVELOCITY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You may cancel your account at any time through your account settings or by emailing us. Monthly subscriptions will remain active until the end of the current billing period. Annual subscriptions will remain active until the end of the subscription year.
We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in conduct we determine to be harmful to the Service or other users. We will provide reasonable notice where possible.
Upon termination, your right to access the Service ceases. Your Customer Data will be deleted within 30 days per our data retention policy.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
For customers located in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may also apply.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or in-app notification. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
